MORTGAGE FORECLOSURE NOTICE
Default having been made in the terms of that mortgage executed on the 25th day of August, 2014, by TIM COUCH and SANDRA COUCH, husband and wife, as mortgagor in favor of State Bank and Trust, as mortgagee, which said mortgage is recorded in the Office of the Judge of Probate, Fayette County, Alabama, in mortgage book 2014 at page 2411 and State Bank and Trust, as mortgagee, having declared all of the indebtedness secured by said mortgage due and payable and such default continuing, notice is hereby given, that acting under and by virtue of the power of sale contained in said mortgage, State Bank & Trust, as mortgagee, will sell at public outcry, for cash, to the highest bidder, in front of the Main door of the Courthouse in Fayette, Fayette County, Alabama, during the legal hours of sale, on DECEMBER 1, 2025, the following described real estate, together with hereditaments and appurtenances there unto belonging and all fixtures now attached to and used in connection with the premises herein described, to-wit:
A tract of land located in the Southeast part of the NE ¼ of NW ¼ Section 27, Township 13, Range 12 West, Fayette County, Alabama, more fully described as beginning at the Southeast corner of said forty and from thence run North along east line of said forty to Public Road and continue Northerly along West side of said road a distance of 630 feet from beginning and thence run westerly a distance of 600 feet to a stake; thence South 630 feet to South line of said forty; thence East along said South line a distance of 650 feet to point of beginning.
LESS AND EXCEPT: A tract of land commencing at the Southeast corner of the NE ¼ of NW ¼ Section 27, Township 13, Range 12 West, Fayette County, Alabama, thence run in a Westerly direction along the South boundary of said forty a distance of 650 feet; thence in a Northerly direction a distance of 447 feet to the point of beginning of the property herein conveyed; thence continuing in a Northerly direction along fence line a distance of 183 feet; thence in an Easterly direction along fence line a distance of 190 feet; thence in a Southerly direction a distance of 277 feet; thence in a Westerly direction a distance of 170 feet to point of beginning.
LESS AND EXCEPT: A lot or parcel of land lying in the East part of NE ¼ of NW ¼, Section 27, Township 13 South, Range 12 West, being more particularly described as follows: Begin at the Southeast corner of said forty and run North along the East line thereof for a distance of 175 feet to an iron pin at the point of beginning, it being the Southeast corner of the lot herein conveyed. Thence run North along said forty line to the point where it is intersected by the West line of the Public Road and continue North along the West line of said Road to an iron pin which is 250 feet from the point of beginning. Thence run West for a distance of 190 feet to an iron pin. Thence run South for a distance of 210 feet to an iron pin. Thence run East for a distance of 190 feet to the iron pin at the point of beginning
Said property will be sold on an “as is, where is” basis subject to any easements, encumbrances, and exceptions contained in said mortgage and those contained in the records of the Office of the Judge of Probate where the above-described property is situated. Said property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. This sale is made for the purpose of paying the mortgage debt, cost and expense of foreclosure.
