Default having been made in the payment of the indebtedness secured by that certain mortgage executed by James J. Johnson, a single man and Cheryl N. Simpson, a single woman, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for United Wholesale Mortgage, its successors and assigns, on May 25, 2017, said mortgage recorded in the Office of the Judge of Probate of Fayette County, Alabama, in Book 2017 Page 1573;
Modification Agreement recorded on 01/13/2021, in Book 2021 Page 78.; the undersigned Lakeview Loan Servicing, LLC, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Fayette, Fayette County, Alabama, on July 1, 2026, during the legal hours of sale, all of its rights, title, and interest in and to the following described real estate, situated in Fayette County, Alabama, to-wit:

Said parcel containing 1.0 acre more or less. 30 foot easement An easement for ingress and egress and utilities being located 15 feet each side of the more particularly described centerline: Commence at the Southeast corner of said North Half of the Northeast Quarter of the Southeast Quarter; then run South 00 degrees, 43 minutes, 14 seconds East for a distance of 660.00 feet; thence run South 83 degrees 58 minutes, 36 seconds West for a distance of 408.21 feet; thence run North 06 degrees, 03 minutes, 57 seconds West for a distance of 210.50 feet to an iron pipe found; thence run North 83 degrees, 58 minutes, 36 seconds East for a distance of 209.97 feet to a 1/2 inch rebar found; then run North 06 degrees, 13 minutes, 12 seconds West for a distance of 15.00 feet to the Point of Beginning of the centerline herein described; thence run North 83 degrees, 58 minutes, 36 seconds East for a distance of 218.82 feet to a point on the centerline of U.S. Highway 43 or Fayette County Road No. 18 and being the end of said easement.

The sale will be conducted subject to: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) final confirmation with the Mortgagee/Transferee, and if applicable, (3) collection of purchaser information needed to comply with the reporting requirements under the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031) and reimbursement of any fees and expenses incurred as a result of the collection of such information.
The Mortgagee/Transferee and Tiffany & Bosco, P.A shall not be liable for any damages whatsoever. If the sale is set aside for any reason, the purchaser at the sale shall be only entitled to a return of the bid amount.
The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
