NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made in the payment of indebtedness secured by that certain mortgage executed by Erica Richman on the 19th day of September 2024, to Grady J. Marsh and Nelle M. Jackson, which said mortgage is recorded in the Office of the Judge of Probate of Fayette County, Alabama, in Mortgage Record Volume 2024 at page 2886; and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Grady J. Marsh an Nelle M. Jackson will sell at public outcry, for cash, to the highest bidder, in front of the front door of the Courthouse, in the City of Fayette, Fayette County, Alabama, during the legal hours of sale on the 21st day of July, 2025, the following described real estate situated in Fayette County, Alabama, to-wit:
Lot Number Seven, Block Number 24, according to the Subdivision survey made by C.B. Stalnaker of the E.P. Goodwin property in the Town of Fayette, Alabama, said lot facing Winston Street (now 2nd Street, Northwest) a distance of fifty (50) feet and extending back East a distance of one hundred thirty-six (136) feet, said lot being 50’ x l36’ and of uniform width, according to said subdivision survey.
A lot or parcel of land being thirty-five feet wide, North and South, and one hundred thirty-six feet long, East and West, and of uniform width, being a part of Lot Number Eight , Block Number Twenty-Four (24), according to the C.B. Stalnaker survey of the E.P. Goodwin Property in the Town of Fayette, Alabama, bounded on the West by Winston Street (now 2nd Street, Northwest), and on the South by the above described lot Number Seven (7); the plat of said survey being now of record in the Office of the Judge of Probate of Fayette County, Alabama; and all of said property lying and being in the Town of Fayette, Alabama.
Commonly known as 316 2nd Avenue NW, Fayette, AL 35555
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Office of the Judge of Probate of Fayette County, Alabama, and will be subject to matters of survey, and to any Federal or State Tax Liens, if any and existing special assessments, if any, which might adversely affect the title to subject property.
Said property will be sold on an “as is, where is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment.
Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage.
This is an action to collect a debt. Any information obtained will be used for this purpose.
