NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made in the payment of indebtedness secured by that certain mortgage executed by Shawn Christopher Leonard and Randi Nicole Leonard on the 21st day of April, 2017 to the Citizens Bank of Fayette, which said mortgage is recorded in the Office of the Judge of Probate of Fayette County, Alabama, in Mortgage Book 2017 at page 1039 and said mortgage having been subsequently transferred and assigned to Gabriel Stovall by instrument recorded in the Office of the Judge of Probate of Fayette County, Alabama, in Mortgage Book 2022 at page 677; and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Gabriel Stovall will sell at public outcry, for cash, to the highest bidder, in front of the front door of the Courthouse, in the City of Fayette, Fayette County, Alabama, during the legal hours of sale on the 24th day of August, 2022, the following described real estate situated in Fayette County, Alabama, to-wit:
A house and lot located at 826 North Aylette Street, situated, lying and being within the City of Fayette, Fayette County, Alabama, being more particularly described as follows:
Begin where the south right of way line of Stewart Street intersects the East right of way line of North Aylette Street; thence run East along the South right of way line of Stewart Street for a distance of 208.5 feet; thence run South and parallel to the East right of way of North Aylette Street for a distance of 208.5 feet to the North line of Sullivan property; thence West along the North line of Sullivan lot a distance of 48 feet to the Southeast corner of the Ayres lot; thence North along the East end of the Ayres lot for a distance of 70 feet to the Northeast corner of said Ayres lot; thence West along the North line of the Ayres lot a distance of 160 feet to the East right of way of North Aylette Street; thence North along the East right of way line of North Aylette Street for a distance of 138 feet to the point of beginning. SUBJECT TO existing easements.
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Office of the Judge of Probate of Fayette County, Alabama, and will be subject to matters of survey, and to any Federal or State Tax Liens, if any and existing special assessments, if any, which might adversely affect the title to subject property.
Said property will be sold on an “as is, where is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment.
Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage.
This is an action to collect a debt. Any information obtained will be used for this purpose.
